GUARANTEES, LIABILITY & CLAIMS
	PAYMENT OPTIONS & CREDIT TERMS We accept cash, check, Visa, MasterCard, or American Express. For orders shipped, a credit card is required and is processed at the time of shipment. CLAIMS POLICIES We strive to deliver quality plants as scheduled to all of our customers; however, we understand that occasionally the need to file a claim will arise. Photos and a written report are required for all claims. Please provide the following information: Windcrest Farm order number Date the plants arrived Photos of the damaged plants and damaged boxes A list of plants showing a potential claim This information will enable us to resolve your claim in a timely manner. Send all claims to: info@windcrestorganics.com Quality & Shortage Claims Quality and Shortage Claims must be filed in writing with Windcrest Farm within 48 hours of the receipt of your order. Photos are required for all claims. Credit(s) will not be issued for claims received over 48 hours after order receipt. Transit Damage Claims Transit damage MUST be noted when RECEIVING the order and noted on Windcrest Farm paperwork. DO NOT discard shipment. Transport claims must be filed with the carrier within 48 hours of order receipt. Remember: DO NOT discard shipment. Without the damaged boxes or photos, carriers have the right to deny the claim. Force Majeure Windcrest Farm shall not be responsible or liable for any delays in service completion due to any cause or condition beyond its control, including but not limited to: fire, flood, earthquake, labor dispute, shortage of materials or supplies, riot or other civil disobedience, war, acts of God or nature, accident, or any acts of any government. GUARANTEES & LIMITATION ON LIABILITY Windcrest Farm guarantees plants that are true to name, visually free of dangerous insects and plant diseases, and in acceptable horticultural condition at the time of shipment. We do not warrant that plants are free of genetic defect, virus, bacteria, disease, mutations, syndromes, insect or other pests. Due to environmental and planting conditions beyond our control, Windcrest Farm cannot guarantee the life and productivity of any plant, and is not liable for plant materials once they are potted or planted by the customer. We will gladly remedy variety problems with replacements of the correct variety. Replacement plants will be provided as soon as production plans permit. Under no circumstances will Windcrest Farm's liability exceed the cost of the plants. EXCLUSION OF OTHER WARRANTIES THE LIMITED WARRANTY STATED ABOVE IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, AND Windcrest Farm HEREBY DISCLAIMS ANY AND ALL OTHER WARRANTIES OF ANY KIND OR NATURE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR FUTURE GROWTH. NO WARRANTIES OR REPRESENTATIONS MADE AT ANY TIME BY ANY REPRESENTATIVE OF Windcrest Farm SHALL BE EFFECTIVE TO VARY OR EXTEND THE LIMITED WARRANTY OR OTHER TERMS. APPLICABLE LAW These terms and agreements shall be deemed made in Union County, NC and shall be governed by North Carolina law without regard to its conflict of laws principles.
